Stadler Rail has filed to withdraw its appeal to Switzerland’s Federal Administrative Court over the Swiss Federal Railways’ (SBB-CFF-FFS) award to Siemens Mobility of a framework contract covering up to 200 double-deck EMUs.
The bidder had contested the procurement on grounds of inadequate transparency, with evaluation documents subject to extensive redactions that precluded meaningful verification of the tender assessment process.
Stadler argued that the available evidence indicated SBB had exercised its full margin of appreciation in favour of Siemens’ unproven, greenfield double-deck design lacking operational validation.
In contrast, Stadler’s bid centred on an evolution of its established KISS double-deck platform, of which SBB already operates 53 high-availability sets representing some of the operator’s most dependable fleet assets.
Unable to access critical adjudication data, Stadler deemed further litigation untenable and formally withdrew the challenge on 7 April 2026.
Chairman Peter Spuhler commented: “We regret the outcome but respect SBB’s decision. Our focus remains on strengthening our strategic partnership with the operator.”
